Update on my crazy life

I don't remember what I have told you all about my house and the damage from Sandy but anyway...the insurance paid us for the inside damage and I'm waiting on a check for the roof. Within the first couple of days one of the 3 roommates moved out.Then I got notice that the other two would be leaving by the first of this month.The second one moved out yesterday on the 3rd. Now the last guy is still upstairs.He was supposed to be moving in with his boyfriend. I still don't see him moving anything out and he keeps asking me when they're gonna start the work on the house.I smell trouble and lots of it.What do you all recommend?!

Tell him the work will start once he has moved out and ask when that will be exactly. Then you might advise how much the rent is per day, past the first when he was supposed to move out.

Absolutely Erin.By the way,they replaced the entire roof today!! They were working from about 7;30 am until not too long ago,about 4:30-5.At least there will be no more water pouring in.There's still plenty of work,replacing sheetrock and now they say the floors in two rooms have buckled from the water and we're going to submit that estimate to the insurance.I'm really hoping all the work is done by the end of the monh so that we can look for tenants again.

You will not believe this craziness,this is definitely a first. This guy is still living upstairs and he thinks we don't know it.He must think that we are really stupid.There is no carpeting or rugs upstairs and we hear every footstep. I figured out why he wanted to know when the work was being done-so he could disappear for the day.He then had the cojones to ask me by text when the security deposit would be ready for him because he's signing a lease next week. He's in for a rude awakening lol.He' been here for about 3 or 4 years so he knows our schedule and he leaves and comes back while we're all asleep.This morning I woke up at 7am and I heard someone going down the stairs and leaving at 8am.Honestly as long as he leaves and eats their deposit this month,I couldn't care less,but this is NUTS! LMAO!!

That is really funny! Can you get some video of his comings and goings? What if he just says "I wasn't living there. Prove it!"?

Well my father hears him too,even wih his bad hearing lol. If this gets to court(which I doubt it will) I assume he would have to prove where he lived if not here

One time when I noticed the footsteps I went upstairs wih my copy of the key.He said he was packing up,put his hand on a duffel which was already packed and zipped up.My brther was right,when he moved in he said he was bad news because his eyes constantly move left to right very fast lmao

I placed a business card for a moving company on the staircase going up to the apartment.They still think that we are idiots,unbelievable. A male friend of mine is coming to see the damage tonight,out of curiosity. I'm not going to warn the tenants and if they're there I'm going to introduce him as the family lawyer and a good friend coming to see the damage. That should hopefully make them a little paranoid

Well,last night I couldn't sleep,I was thinking about them and getting even more angry.I waite until I heard them awake and moving around and I sent the bastard this text:

Good morning Daniel.You must move out with all your personal effects by midnight Thursday Dec 20.The morning of the 21st I'm going to hire some men to move what is left out to the curb.You've lived here one month too long.

He didn't respond and since the morning I've been hearing the muffled voices of him and his boyfriend.

I wish I could do it Rebecca,it's a bluff.It's illegal to touch their stuff,to change locks or anything.I figure that maybe they don't know the law and might leave.If I get rid of their junk they could sue me for their junk pieces of used crappy furniture that they found on the street/bought off Craigs list for 5 dollars each.

If he's not currently paying rent, I don't see why you couldn't serve him with an eviction notice(I know they make it almost impossible these days to kick a sleezy renter out). It been a while since my grandparents have been landlords, but I remember a few times they would have to have the sheriff to come out to serve an eviction notice(usually came with a 48 hours to vacate before the locks would be changed)... its probably gotten a lot harder to evict someone.

I would say for future renters to go into great detail on the rental agreement(as much as your local laws allow), so you can have some leverage to get people out.

I tell you Jessica this isn't the first time for us possibly evicting someone.They make it so easy for slimey tenants to live for free .Here in NY I have to get a lawyer first.He then has a 3 day notice to vacate then when they don't lawyer gets a court date set which usually takes a month or more.It then takes at least 2,3 or 4 court sessions to evict.It's so ridiculous.Landlords have very little if any rights

Ok guys I think I must have a ghost in the apartment upstairs,no joke.We have been hearing footsteps and muffled voices upstairs from here.My tenant came to visit from Manhattan and says they haven't been there,he's been living in Manhattan with his boyfriend,and I can go upstairs whenever I want.This is even crazier.

Hahahaha! If you're haunted I want to come for a visit! I'm still disappointed that my mom has not come back to haunt me after her death. We loved sharing scary books - she loved that "scared to death" feeling as much as I did.

Lmao Lori,we (my brother and I) love scary movies.We have been watching them since we were little kids.My mom would walk in and say "ewe,how can you watch these things",we would laugh,but she never stopped us from watching them lol. Your mom would never haunt you,don't be silly.Come on over! Hey I just figured out what the muffled voices were,my brother has some strange dvd on and it's voices lol!!Now for the footsteps
